Wrongly Sentenced!

Trip out, I've tried to write this 3 times, and couldn't. So here goes the 4th attempt. Does the state of California, give out convictions based on what a person has done in their past, or because of the type of business that they own? I have had a couple of friends, who have done time, and have had similar situations happen. Where the only reason that they couldn't get a fair trial, or were arrested or harassed by police, was simply because of their past, or...present forms of employment. One of my former friends actually wound up committing suicide, rather then being unfairly judged by a biased jury. He must have known what kind of sentence he would get, because he made porn, and then killed his best friend. His name was Steve Driver, but what I want to know is, does California make character assassinations, based on how moral a persons conduct in their everyday life was? Making these life destroying decisions, and not on the actual crimes that these people have actually committed.

Case in point: there was a porn star who was named Brian Surewood. Now Surewood was a defendant that was involved in a vehicular manslaughter case. Where he and another teenage man, had an argument while driving really high speeds, he slamed into that parked car. The parked car, hit a family that was in another car, a couple of cars parked in front of it. The car that was hit by the first car crumpled from the pressure of being hit. The mother lost both her legs and the daughter was killed instantly. The father was crushed by the weight of what had happened to his family. So the story goes, both men were held on 15 million dollars bail. Except Brian received 11 years, when he was convicted. That seems fair right? Well it doesn't seem fair to me! Considering that our lovely mayor, wanted to make an example out of the case. And if you consider that most vehicular manslaughter cases, up until that point, received half that time and most received probation. Then you'll start to realize, just how unfair this case was. Now Major Villaraigosa, who was mayor when Brian got in trouble. Wanted to make an example out of Brian and the case! Meanwhile, this goodie good doer, was having a secret affair behind his old lady’s back with a hooker. Plus he did everything that he could, to see a man that he didn't know. Who's only real crime, was being involved in a accident with a vendictive teenager, do the maximum time, for a crime that he had no intent to commit.

This is what Brian Surewood's wife wrote about what the State of California allowed to happen to Brian; it was Major Villaraigosa who took the opportunity to come out of hiding from his own cheating scandal during Brian's case and he got on TV stating the he was going to make an example of them before Brian's arraignment. This is when the buzz on the news was that Brian was first engaged in a street race with the teenager and then the story changed that it was a road rage. It was neither! The kid lied, if you know the details of the case it is plain and clear. The whole case was built on this adolescents self serving lie. After Brian's family could no longer afford to re-hire the preliminary attorney, Peter Korn for the coming pretrial we went through many court appointed "free" public defenders that would cancel out on us with no explanation except that it was a conflict of interest. What we heard through the grapevine was that the case was a political one and they didn't want to be part of it. This is how we ended up with the lazy lawyer Ron Miller aka Don Hollywood who didn't do anything for Brian's case except to try to work out a plea bargain with the prosecutor instead of making an effort to put out all the evidence proving Brian's innocence.

Once again I will repeat what you won't find this information in your media research. This is why I started the Innocent page to tell the other side of this case that was not exposed. The part that I experienced during the preliminary and the pretrial. This is the part that I say anyone can verify what I am saying by going to Van Nuys court and requesting the court transcripts which is public access. Racing and driving fast is part of what Californians used to do on the weekends. Hollywood has made movies about illegal street racing and driving fast. With the only difference between my dad and I from Brain is; my dad and I don't own pot shops and my dad isn't an ex porn star. Something that the state of California, has really tried to crack down on for the last couple of years. Both porn and the pot business have been on the minds, of many an elected official. So does 11 years of prison time, still seem fair to you? Do you think Major Villaraigosa will suffer any of the same consequences, from his illegal dealings with his hooker? Did his life and business go on as usual, after people found out about his affair? Unless you think it's kosher to be banging a whore behind your wife’s back, while your the mayor, while you're still married? But then it looks like Arnold has made that same mistake too, with his maid. It's a sad state of affairs, and a lot of the men in government, have been caught cheating or trying to cheat of late. Do I personally believe that Brian is innocent? I know he's not innocent, he was there and people did get hurt and did die. Where his actions intentionally done? No they weren't! What the judicial system did to Brian, could be mirrored to what it would be like, if, you threw the owner of an airline under the bus, simply because that air-plane crashed. Yes! Brain should pay a fine and do a couple of years and get probation, and maybe, pay the family money for 5 or 6 years as compensation for their horrible loss. I personally believe that losing 11 years of your life, because, of an accident is just unfair. I think what happened to Brian is wrong! When there are so many defendants in so many vehicular manslaughter cases, who have done the same crimes, but have gotten a lot less prison time. It just doesn't seem fair to me, to make an example of one man, when thousands have gotten away with little or no time for similar accidents. So Major Villaraigosa who is no moral representative at all, should have kept his dirty nose, out of Brian Surewood's trial but didn't, and then decided to make an example out of the Surewood case. I ques that took some of the heat off his own affair, and some of the heat out of his political life. Way to go Major Villaraigosa!

I believe, that this poor man, deserves a re-trial. I believe this simply because an eleven year sentence for an accident, is just to long of a time, to serve for any accidental tragedy. Especially because this accidental crime, was not done intentionally, and there was no intent to commit a crime. From the very beginning of this case it should have been free from prejudice. Prejudice against what he had done in his past. Porn should not be a factor in any case, or send anyone to prison. Along with the fact, that he owned a marijuana dispensary, which shouldn't hold any weight in any criminal case either. The case should be re-tried only on the facts! Now that Major Villaraigosa made a hasty decision, making a scapegoat out of Brian Surewood. The State of California has a duty to it's citizens, to retry this case. Why? It simply isn't just, to send someone to prison for 11 years, because of an accident. Or because a mayor, wants to make someone into a scapegoat, to deter crime. Look accident's happen! At anytime anyone of us, who gets into any vehicle, all have a chance of getting killed. Now those are the chances that we have chosen to take when we get into any car. Should anyone who accidentally killed a person, have to serve 11 years in prison? With the only reason being that Brian can serve as some kind of an immoral mayors scapegoat. As some kind of a scare tactic for all the people who do illegally street race. The police gave a face to illegal street racing, which was something that the media told us, that Brian was a part of, which simply wasn't true! That act was a lame attempt to deter crime? I don't think that blaming any one man, for an accident, that obviously was an accident is right.  What do you think?

This story was edited because I do not want to promote the hype by main street media and porn blogs on the Internet. This story was in no way meant to offend or infuriate anybody. My goal is the same as Brian Surewoods wife which is to say that what happened to him is wrong. I have changed the facts in the case to the facts that really happened that night. I know the media does lie. The story has been changed and no, Brian was not involved in an illegal street race.
